Terms and Conditions   

1. Introduction

These are the terms and conditions that apply when you reserve accommodation managed by Jacob and Sons Accommodation Ltd located in the UK using one of our digital channels (such as our website, mobile site or app). When you make a reservation, you will be asked to confirm your acceptance of these terms and conditions.

We reserve the right to amend these terms and conditions at any time and you should therefore check them each time you make a reservation.

The terms and conditions applying to your reservation will be those in place on the date that you make your reservation.

These booking terms and conditions of business are a contract between the accommodation provider Jacob & Sons Accommodation Ltd and yourself the person making the booking.

2. Reservations

To reserve your accommodation please follow the instructions on the website, mobile site or app (as applicable).

You must be at least 25 years or over to make a reservation.

You will need to provide your credit or debit card details to secure your reservation. Please check that the details of your reservation are complete and accurate before you confirm your reservation. We will not be liable for any delay or non-performance if you provide us with incorrect information. We will confirm our acceptance of your reservation by sending you an email to the email address that you provide during the reservation process. The contract between us for the provision of your accommodation and any additional services added to your reservation will be formed when you receive this email confirmation from us. If you think that there is a mistake in your reservation or if you require any changes to a confirmed reservation, please contact us to discuss. For more information on cancellation, please see section 6 Cancellation, below. Your stay is not intended to confer exclusive possession, nor to create the relationship of landlord and tenant between Jacob & Sons Accommodation Ltd and yourself. You as the guest will not be entitled to any tenancy, any Assured Shorthold or Assured tenancy, or to any Statutory protection under the Housing Act 1988, or to any other Statutory security of tenure now or upon the termination of this agreement.

Rates are subject to change without notice. VAT is charged where applicable.

3. Room prices

Jacob and Sons accommodation Ltd adopt dynamic pricing and the price of our accommodation fluctuates based on demand. When you make a reservation request, we'll give you the total price for the accommodation, the number of guests and the number of nights you've requested. The price you pay is the price quoted to you at the time you make your reservation. Accommodation prices are based on the number of guests per accommodation per night and are inclusive of VAT at the applicable rate at the time of your reservation.

Though parking for one vehicle is included in this booking, extra vehicles and pet fees are not included in the accommodation price and will be invoiced separately.

4. Occupancy

Jacob and Sons Accommodation Ltd permits you as a guest to occupy the property, such occupation being exclusively by you and to use our furniture and effects for the accommodation period.

All visitors to the accommodation are your responsibility. You must not exceed the maximum occupancy for the accommodation. We reserve the right to conduct checks on occupancy. Occupancy is not transferable. If the number of guests exceeds (also applicable to children over 3 years old) the number of guests on the booking, we reserve the right to charge an extra fee of £50.00 per night per additional guest. Alternatively, we reserve the right to ask excess occupants to vacate the property.

Jacob and Sons Accommodation Ltd reserves the right to refuse to accept any booking for whatever reason they deem acceptable.

5. Paying for your accommodation

The payment is due at the time you make your reservation. Cleared funds must be received 7 days before the arrival date. Should payment not reach us within the required time, we reserve the right to cancel any bookings made.

6. Cancellation

Your right to cancel:

Bookings can be cancelled 7 days before arrival. A full refund will usually be processed to the same debit/credit card the next working day; however, it may take a few days for the funds to reach your account. A cancellation reference will be given and should be retained as proof of cancellation. If cancelled or modified within 7 days prior to arrival, or in case of a no-show, the total price of the reservation will be charged. No refunds will be made for non-arrivals.

Your breach:

We may cancel your reservation at any time with immediate effect by giving you written notice (which includes email) if:

* you do not pay us when you are required to do so, or you break the contract between us in any way. If we cancel your reservation where you are at fault, we reserve our legal rights in respect of your breach of contract. Where your stay had/has not yet commenced, the total payment made or to be made by you for the such room shall be deemed a cancellation charge and is not for any service.

Events outside our control

In the unlikely event, Jacob and Sons Accommodation Ltd has to cancel or make a change to your accommodation, we will use all reasonable efforts to contact you as soon as possible to explain what has happened and to inform you of the cancellation or change to your booking. If possible, we will offer you an alternative accommodation, but should this alternative be unacceptable to you, the booking will be treated as cancelled and we will refund any money you have paid within 7 days of any cancellation.

Jacob and Sons Accommodation Ltd shall not be liable for changes, cancellations or any other effect on your booking due to events beyond our control (force majeure). In these Conditions, force majeure means any event or consequences thereof which could not be reasonably avoided by us, even with the exercise of all due care. Such events may include war or threat of war, civil strife, terrorist activity, industrial dispute, natural or manmade disasters, fire, adverse weather conditions and all similar events outside of our control.

If you wish to alter your booking, Jacob and Sons Accommodation Ltd will use our best effort to accommodate your requirements, however, you will be obliged to pay any additional expenses incurred as a result of the alteration. In addition, we may charge, at our discretion, an amendment fee to cover the necessary administrative costs incurred.

7. Arrival and departure

Accommodation is available from the time specified prior to the booking. However, you must inform us of the arrival time to activate the digital key lock box for your arrival.

Accommodation must be vacated by 11:00 am (unless specified otherwise) on the day of departure. Failure to leave your accommodation by this time may result in a late check-out charge of £30 per hour or a fraction of the hours.

8. Keys

Unless otherwise agreed, Jacob and Sons Accommodation Ltd will issue you one key to the property. If you lose the key, you must notify us as soon as possible and we will instruct a locksmith to change the lock/key(s) at your expense. If you lock yourself out of the property and require our assistance to re-enter the property, we reserve the right to charge you a fee of £50 GBP. Jacob and Sons Accommodation Ltd will retain keys to the property and will access the property to provide the services set out in the agreement and any necessary maintenance and also to inspect the property and carry out repairs to the structure, roof, exterior or any services, appliances or equipment therein. We reserve the right to enter the property at any reasonable time during your stay for essential maintenance or if we suspect damage has been caused or in case of any emergency or concern.

9. Pets

Pets are permitted to some units, subject to obtaining prior consent and additional payment prior to arrival.

Under no circumstances can pets be left unsupervised.

10. Services

Jacob and Sons Accommodation Ltd will not be held responsible for any failure or interruption to services to the room, for example, gas, water and electricity, or for any damage, disturbance or noise caused as a result of maintenance work being carried out in any part of the building.

Wireless Broadband Internet and Hardwire Wireless Broadband Internet are usually available at the accommodation. However, Jacob and Sons Accommodation Ltd will not be liable for the loss of this service due to connection, environmental or human error and no support service is available. For this reason, wireless broadband internet is not a contractual provision.

We do not assume any responsibility for any damage to your computer or the data contained on it, nor the security of any data transferred over the internet. You are responsible for the protection of your computers from loss of data, unauthorized access or viruses. Maintenance Call-Outs Should you report that a service or an appliance is faulty and subsequent inspection confirms that the appliance was not faulty but was not being operated properly by you and where usage instructions have been provided in the GUEST GUIDE, we reserve the right to charge you for the maintenance call out charge.

11. Our expectations of you (and your group)

You must not:

*smoke anywhere inside the accommodation. This includes the smoking of e-cigarettes. Permitted smoking areas will be identified on-site. Smoking in accommodation or outside of the designated smoking area will result in a £150 fine.

*bring any pets into accommodation (with the exception of assistance dogs) without prior consent (charges may apply). Subject to prior consent and additional payment the pets may be allowed at the property, however, they must always be supervised and under no circumstances left alone at the property. The pets are not allowed to come on the beds or any other furniture. It is your responsibility to clear up after your pets.

*leave the kitchen while cooking, always closes the kitchen door to stop the smell from spreading to the other rooms.

*leave dirty dishes, or untidy work surfaces and cooker before check-out.

*bring any potentially dangerous or hazardous materials or equipment onto the property.

*use any electrical appliances that may set off the fire alarm system, such as toasters, mini cookers or portable grills.

*tamper with any fire alarms or emergency equipment.

*utilise accommodation to store items (personal or otherwise) which could in the sole opinion cause damage to the room or be a risk to the health and safety of the guests and property.

*prevent Jacob and Sons Accommodation Ltd management, housekeeping and/or maintenance staff from access to accommodation as and when required by the company, with housekeeping permitted full access at least once every two days;

*remove, damage or destroy any of our property.

*use any of the technology provided by Jacob and Sons Accommodation Ltd to download or access any unlawful or obscene material; or cause unreasonable disturbance to our neighbours.

* light candles, incense or attempt to light a fire in a hearth, not to cook dishes that may leave a pungent smell in the apartment.

* do or permit any act that would make any insurance policy on the property void or voidable or increase the premium.

* use the accommodation for business purposes.

* block or put noxious or damaging substances into the sinks, baths and lavatory cisterns or waste or soil pipes in the property or allow them to overflow.

* leave the entrance door or windows to the property open but ensure that all door and window locks are properly engaged at all times. All windows must be closed when not in the room or during bad weather.

* change any locks to the property or have any duplicate keys made.

* play ball games inside or within the grounds of the accommodation.

* do anything that may cause a nuisance or annoyance to the owners or to any other occupier, Guest or neighbour of adjoining properties or do anything at the property that is illegal or immoral. Noise disturbances after 10 pm and before 7 am can be reported to the police.

You must:

* undertake to provide all suitable childproofing safety equipment if arriving with small children.

* store general rubbish only in black plastic bags and close the rubbish bins all the time, separate recyclable rubbish according to Portsmouth City Council rules and conditions. Take a duty to dispose of the rubbish in the bins provided.

* ensure that at the check-out the property is cleared of your effects and accommodation is left in good repair and reasonably tidy condition and make good, pay for the repair or replacement of such items of the fixtures, furniture, furnishings and other effects as shall be broken, lost, damaged, or destroyed save as for reasonable wear and tear excluding matters covered by insurance.

* to take all reasonable precautions to prevent condensation by keeping the property adequately ventilated and heated. Extractor fans located in the bathrooms must be switched on at all times to prevent damage to the accommodation.

* report any plumbing, electrical or general problem to the owners as soon as practicably possible and desist from attempting to remedy such problems on their own.

Group bookings:

* ensure that the number of people occupying the property does not at any time exceed the maximum number of permitted occupants set out in your booking of the relevant property. If you or your group cause damage or loss of any kind to the accommodation, other guests or their property, you (as the person making the booking) will be responsible for that damage or loss and you shall be liable to pay Jacob and Sons Accommodation Ltd on demand the amount required to make good or remedy such damage or loss.

*You and the members of your group must not resell or transfer your reservation (or any part of it) nor advertise, market or otherwise offer any Jacob and Sons Accommodation Ltd accommodation for sale either on its own or as part of a combined offer. Jacob and Sons Accommodation Ltd will not honour any reservations made in this way and does not accept any liability for doing so. If you are a Tour Operator and wish to book the accommodation you should contact relocation@jandsons.co.uk If you or your group cause damage to the accommodation, guests or their property, or otherwise breach any of these terms and conditions,

we reserve the right to:

* cancel your reservation with immediate effect and (if appropriate) eject you from the accommodation.

* cancel key entrance codes.

* restrict access to the accommodation.

* remove your items from the accommodation, disposing of such items (at no cost and no liability) to a local charity to the extent such items are not collected from us within 7 days of removal;

* retain all sums paid by you and/or charge you the full amount of your reservation, and/or

* refuse future reservations from you and/or refuse entry or accommodation at any of our accommodations. Jacob and Sons Accommodation Ltd will not be liable for any refund or compensation in such circumstances.

Jacob and Sons Accommodation Ltd reserves the right to decline or cancel reservations made and stays in progress by those who have previously breached these terms and conditions (as may be updated from time to time), whether the reservation is in that name or not.

12. Data Protection Policy

When signing the Terms & Conditions, you’ll need to present proof that you are the person who made the reservation and that you are over 25 years of age. Acceptable forms of identification are a passport, driving licence, ID card or police warrant card. You will be asked to provide proof of identity and nationality prior to check-in.

We keep your personal data safe and secure. This personal data will be subject to the appropriate legal safeguards as specified in the GDPR Compliance Data Protection Act 2018.

Jacob and Sons Accommodation Ltd fully endorse and adhere to the eight principles of the Data Protection Act. These principles specify the legal conditions that must be satisfied in relation to obtaining, handling, processing, transportation and storage of personal data.

The principles require that the personal data shall:

1. Be processed fairly and lawfully purpose and shall not be processed in any manner incompatible with that purpose;

2. Be obtained for a specified and lawful purpose and shall be processed in any manner incompatible with that purpose;

3. Be adequate, relevant and not excessive for those purposes;

4. Be accurate and, where necessary, kept up to date;

5. Not to be kept for longer than is necessary for that purpose;

6. Be processed in accordance with the data subjects' rights;

7. Be kept secure from unauthorized or unlawful processing and protected against accidental loss, destruction, or damage by using the appropriate technical and organizational measures;

8. And not be transferred to a country or territory outside the European Economic Area, unless the country or territory ensures an adequate level of protection for the rights and freedoms of data subjects in relation to the processing of personal data.

13. The contract

This contract is formed when we confirm your reservation is between you and Jacob and Sons Accommodation Ltd. No other person shall have any rights to enforce any of its terms, whether under the Contracts (Rights of Third Parties Act) 1999 or otherwise.

14. Your Rights

Your statutory rights are not affected by anything contained within these Terms and Conditions of Hire.

15. Our liability

Jacob and Sons Accommodation Ltd shall have no liability to the Guest for the death or personal injury to them or any members of their party unless this results from an act or omission on our part.

We do not seek to exclude our liability for fraudulent misrepresentation by us or our employees or agents.

We do not accept liability for failure to meet any of our obligations where such failure is due to events beyond our reasonable control.

If we breach these terms and conditions for reasons within our control we shall only be liable for losses that are direct losses and a reasonably foreseeable consequence of the such breach.

Save as prohibited by applicable law, we shall not be liable whether in contract, tort (including negligence) or for breach of statutory duty or in any other way, for any indirect or consequential losses including

* loss of income, sales or revenue;

* loss of business;

* business interruption;

* loss of profits or contracts;

* loss of anticipated savings;

* loss of data;

* loss of reputation and/or goodwill; or

* wasted management or office time.

Where we are liable to you (save as prohibited by applicable law) our maximum liability to you whether in contract, tort (including negligence) or for breach of statutory duty shall in no event exceed the price of your reservation. 

16. Applicable law

These terms and conditions, their subject matter and formation (and any non-contractual disputes or claims) are governed by and construed in accordance with English law. If you are a consumer you and we both agree that the courts of England and Wales will have non-exclusive jurisdiction over any claim arising from, or related to, your reservation and/or stay at any Jacob and Sons Accommodation Ltd managed accommodations.

We retain the right to bring proceedings against you for breach of these terms and conditions in your country of residence or any other relevant country. If you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland.

If you are making a business reservation, you and we agree that the courts of England and Wales will have exclusive jurisdiction over any claim arising from or related to your reservation and/or stay at any Jacob and Sons Accommodation Ltd managed accommodation.

17. Severability

If any part of these terms and conditions is deemed invalid, illegal or for any reason unenforceable then that part will be deemed deleted and will not affect the validity and enforceability of the remaining parts. Any failure by us to enforce our rights or remedies under these terms and conditions or otherwise shall not be construed as a waiver by us of those or any other rights or remedies. All rights not expressly granted in these terms and conditions are reserved.
